attack on expert witness immunity
The Autumn conference season continues into November with the annual Bond Solon Conference.
An expert witness currently enjoys immunity from suit in
respect of his performance in the witness box and the content of his report. However, this may change when the Supreme Court
hears an appeal in the case of Jones -v- Kaney. Roger ter Haar QC has been instructed for the appellant in this test case on expert witness
immunity and will talk about the implications for expert witnesses.
This year the Right Honourable Lord Justice Moses will be giving the keynote address. In the Shaken Baby appeals (Henderson v R.  EWCA Crim 1269), Moses LJ expressed the view that
expert evidence from those in practice could provide a ‘far more reliable source’ than that of experts who had retired. Do you agree?
Speakers at the conference will also consider the possible ramifications for expert witnesses of the Jackson report into civil litigation costs. Will there be
